Terms and Conditions of
Service.
Quote and pricing
A
quote/evaluation for prospective project is free of charge
and valid for 60 days. The quote might be issued based on
hourly rate at $75.00 per hour or as firm fixed price. The
firm fixed price includes minor changes/corrections in the
fabricated Model. Minor changes are those requiring
less than one working day of total additional time. Changes
requiring in excess of one working day or required in
addition to original agreement are considered major changes
and will be billed at the rate of $75.00 per hour in
addition to the agreed/estimated price. Customer must agree
to all changes in writing, by signing a designated spot in
the job agreement.
Firm
fixed price includes delivery of Model to the office
of the local customer (residing within 150 miles radius from
Philadelphia, PA). Cost of shipping and handling of the
Model/Master to the remote customer’s location is not
included in a firm fixed price and will be added to the
final invoice.
Reference Materials
All
reference materials must be submitted by customer. Customer
is fully responsible for legality (including copyright
etc.), content, and accuracy of submitted reference
materials. Search for reference materials or additional
reference materials can be provided at a charge of $75.00
per hour plus cost of purchased literature. Purchased
literature is a property of client and will be released to
client after project completion or cancellation.
Model
Fabrication
The
Model fabrication is based on briefing with customer
and reference materials.
The
Model is considered “in fabrication” upon signing the
job agreement by customer and receiving the deposit payment
unless agreed payment conditions are “Full payment upon
completion” which applicable for Government jobs only.
Company
utilizes the services of outside manufacturers and
suppliers, and thus cannot be responsible for changing
costs, time of order turnaround or other terms and
conditions of outside and third party providers. Any
additional charges due to third party providers or outside
sources will be responsibility of customer.
Company
does not responsible for delay in project’s fabrication
caused by customer’s actions. Company reserves the right to
put on hold project fabrication due to delayed progress
payment or provision of requested reference materials.
Rights
In case
the project includes a use of images, designs, objects and
other materials which are or might be a subject for
licensing, customer is fully responsible for all legal
aspects of such licensing.
Due to Company’s profile specifics, Company does not claim
to keep any rights or copyright to fabricated Model
and its replicas. At the moment of receiving a full payment
for ordered Model all rights are being transferred
automatically to the Customer in their entirety, no
additional certification for the transfer of the above
rights is required.
Company
reserves the right not to release the Model and
collateral products and materials unless paid in full.
Company
reserves the right to photograph, duplicate, and utilize
images of fabricated Model and based on Model
final products for Company’s own marketing and advertisement
purposes unless above information is classified.
Cancellation and
Pending Fabrication
Cancellation of project/service refusal can be made by
customer at any time, by any reason. In case of project
cancellation/service refusal, initiated by the customer,
customer is responsible for paying a cancellation fee in
amount of 10% of total agreed/estimated price and for
compensation of the time spent for Model fabrication
so far at $75.00 per hour.
Project
fabrication can be put on hold upon customer’s request,
pending changes in design or for other reason. In case of
pending fabrication, initiated by the customer, for the
period more than one calendar week, customer is responsible
for partial payment in order to compensate the work
completed so far. Continued pending of the project
fabrication for more than 12 calendar weeks will be
considered as project cancellation/service refusal.
Model Handling
Models are easily breakable and require handle them gently.
Company does not provide a warranty for fabricated
Models and does not accept responsibility for
Model lifetime unless stated otherwise. Repairs can
be made at a charge of $75.00 per hour.
Payments and payment
terms
Payment
to be made in accordance with the agreement and invoices
submitted. Shipping & handling costs and taxes as required
are added to invoice. Payment may be made by company check,
money order, cashier’s check or cash. Company accepts Visa,
MasterCard and Pay Pal.
A charge
of $32.00 will be assessed in the event of a returned draft.
A charge
in amount of 2% of total agreed price per month will be
added to any payment not made by the due date. In the event
Company employs an attorney or/and collection professionals
to collect unpaid balance, Customer shall be responsible for
all costs of collection including attorney’s fees,
collection fees and expert witness fees.
